Being pulled over and arrested or charged with a DWI can be very intimidating. What might seem hopeless in the event that you are charged doesn't have to end your career, social life or driving privileges. Also just because you received a DUI doesn't mean that you're a bad person..

I just got arrested for a DUII charge in Happy Valley Oregon. What happens now?

You've just been arrested for suspicion of driving under the influence of intoxicants in Happy Valley, Oregon. You're handcuffed, sitting in the back of a police cruiser and have no idea what to expect next. If this scenario describes you, you are probably overwhelmed with fear and worry. You have good reason. Oregon is one of the toughest states when it comes to DUI prosecution and punishment. Without adequate legal protection, you may be facing a myriad of penalties from stiff financial penalties, suspended driving privileges, a conviction that cannot be wiped from your record to jail time. The good news is that Oregon DUI Attorney Rhett Bernstein has your back. He brings experienced, competent legal representation to those arrested for or charged with DWI in Oregon..

Here are a few things that you need to know about DUI arrests in Happy Valley, Oregon:

First, not everyone who is cited for DUI in Happy Valley is arrested and booked into jail. If you were released with just a citation, don't think that your troubles are over. You will still need to appear in court to answer for your charges on the date provided by the arresting officer.

If you were booked into jail, you will most likely receive a release agreement that offers you instructions for appearing at court date to answer for your charges. However, if you were booked on felony DUI charges, you may be held until your court date or until you are able to post bail.

Regardless of how your DUI arrest was handled by authorities, you will have a court date that you are compelled to attend. Otherwise, an arrest warrant will be issued and you will be re-arrested and held until you appear in court. This is why it is in your best interest to find competent legal counsel quickly.

Where am I supposed to appear for court?

You will need to consult the information that was provided to you. Your citation and/or your release agreement will indicate which court will handle your case. In most cases, your case will be heard at the Clackamas County Circuit Court, which is located at 807 Main Street in Oregon City, Oregon. Arraignments for folks out of custody take place Monday through Thursday at 1:30 PM and 3:00 PM. Arraignments for folks in-custody take place weekdays at 3:00 PM via video from the Clackamas County Jail. You will be responsible for finding out where your case will be heard and the date of your arraignment. Appearing on the right date and time is very important.

Are there any sentencing options that are unique to Clackamas County?

In most cases, no. Clackamas County does not generally subscribe to a work in lieu arrangement nor do they generally offer community service as part of the penalty phase of a DUI conviction. Most other area counties also do not offer these as options. Oregon is well known as a state that is tough on DUI offenders and will generally adhere to jail as a sentence in an effort to deter offenders from recidivism.

It is important to note that while individual counties such as Clackamas County have the jurisdiction to hand down penalties based on the judge's own preference, DUI in the state of Oregon is a state crime and certain mandatory penalties do apply such as license suspension, a conviction that cannot be expunged, supervised probation, stiff financial penalties and jail time.
